1 総則およびウェブサイトの利用
1.1 本規約（およびツアーの該当サービス提供者との規約）は本ウェブサイトの利用に関する、もしくは利用者が（または利用者のために）予約されたものに関連した利用者とみゅうとの合意事項とする。みゅうは本規約を必要に応じて訂正および変更する権利を有する。本ウェブサイトでの予約は本規約を十分に確認した上でのものとする。サービス提供者の規約は依頼があった場合、提供される。利用者は本ウェブサイトを利用、もしくは本ウェブサイトを通して予約をすることによって本規約に同意したものとみなされる。1.2 法によって認められる範囲でみゅうは法令、慣習法により生じるものであるか否かを問わず, 本ウェブサイト内の情報の保証を放棄し、契約法、(過失を含む)不法行為法その他本ウェブサイトより発生した、またウェブサイトにアクセスが遅いため、アクセスが出来ないため発生した破損や紛失に対して一切の責任を負わない。
1.3 本規約は、後日参考できるよう、一部保存または印刷することを勧めます。
1.4 ツアー、手配申し込みの際に、ページ上の“同意します”ボタンをクリックし、送信することによって利用者は本規約に合意したと見なします。同意できない場合は本ウェブサイトを通しての予約はできないものとする。
2 定義
予約 顧客により本ウェブサイトもしくはメールによってなされた予約がみゅうによりそれが確認された場合を指す;サービス提供者 とは以下4条に記されているサービス提供者、またはみゅうによって任命されたサービス提供者を指す;
総額 予約されたツアーにおいてみゅうに支払われるべき費用の全額;
ツアー みゅうまたはサービス提供者によって手配されたツアー;
Myu とはミキグループ各社が提供する、旅行手配、観光ツアーの手配の総称です。各々のグループ会社の連絡先は以下3条に記す。

4 サービス提供者
4.1 ツアーまたはサービスによってはウェブサイトに提示された第三者によって手配される。5 利用者の立場
5.1 本ウェブサイトを通して手配を依頼することによって利用者は以下を保証する。:(a) 法律上拘束力のある契約を終結でき、
(b) 18歳以上である。
6 利用者とみゅうとの契約
6.1 利用者によって申し込みが記入され送信された後、みゅうより受領を確認する自動返信メールが送られる。このメールは予約が確認された事を意味するものではない。（特定のツアーはお支払い完了と同時に申し込みが確定します。それらのツアーは申し込みフォーム上にて即時確定対象のツアーであることが明記されています）
6.2 申し込みはみゅうによる予約確認の対象となり、予約が確認されて初めてみゅうは総額の請求の手続きをする。
6.3 支払いが受領された時点でみゅうは利用者の申し込みをメールにて確認し、この際にはじめてツアーの提供に関して利用者とみゅうとの間に法的契約が成り立つものとする。
6.4 利用者の予約に対しての支払いが受領された時点で、予約されたサービスを利用する際に提示してもらうバウチャーが発行される。同時にその他書類やチケットが必要であれば案内がなされる。
7 支払い
7.1 総額の支払いはビザカード、またはマスターカードによるものとする。 ロンドンはJCBも利用可能。8 予約申し込み期日
8.1 予約の申し込みはツアー出発2営業日前（週末、祭日を除く）の（該当みゅう会社の現地時間）17:00までにみゅうに届くものが予約申し込みとして受領される。9 みゅうによる催行中止
9.1 みゅうは予約、みゅうのツアーまたその他手配を中止する権利を有する。例えば、（ツアーに参加する大人の人数が）催行人数に満たない場合、ツアーはキャンセルされる。このような場合、みゅうは適切な期間内に利用者に連絡をしツアーのために支払われた総額を返済する。このようなキャンセルの場合みゅうは責任を負わない。他のツアーにおいて欠員がある場合別のツアーへの申し込みを可能とする。他のツアーに欠員があるか、または今後の出発日に関してはみゅうと確認していただく必要がある。9.2天災、不慮の災害、政変、戦乱、ストライキ、その他不可抗力の事由によリツアーの実施が不可能となった場合、当該ツアーの実施を中止することがある。このような場合予約において支払われた総額は返済されず、キャンセルに関してみゅうは責任を負わない。
9.3みゅうはツアーに関連したイベントが開催されていること、ツアーの訪問先が営業していること、また観光資源や施設が運行されていることを保証しない。美術館、城等の予期せぬ閉鎖、イベントによる交通規制、レストランの閉鎖など現地の理由によりツアーがキャンセルになる場合がある。
10 変更と取消
10.1 利用者が予約をキャンセルまたは変更する場合には該当する上記みゅう連絡先にメールを送る必要がある。すべてのツアーに関して最低出発日２営業日前（週末、祭日を除く）にみゅうに届いた変更、取り消しについては総額を返済する。
10.2 ロンドン以外の都市から出発するツアー：ツアー出発日1営業日以前（週末、
祭日は数えない）のキャンセルまたは変更は50％のキャンセル料の対象となり、みゅうはツアーのために支払われた総額の半分を返済する。
ロンドンから出発するツアー：ツアー出発日2営業日前（週末、祭日は数えない）
のキャンセルまたは変更は50％のキャンセル料の対象となり、みゅうはツアーのため
に支払われた総額の半分を返済する。
10.3 ロンドン以外の都市から出発するツアーのキャンセルまたは変更がツアー出発当日、または1営業日に満たない場合、100％のキャンセル料の対象となり総額は一切返済されない。
ロンドンから出発するツアーのキャンセルまたは変更がツアー出発当日、または2営業日に満たない場合、100％のキャンセル料の対象となり総額は一切返済されない。
例外として、2012年7月25日から2012年8月14日までの期間に運行されるみゅうコッツウォルズA,B.Cコースに関しては、申込と同時に100％のキャンセル料が発生する。
10.4 パリのシティラマ社 みゅうパリ支店が予約するシティラマ社のツアーのキャンセル条件は以下に準じます。
ツアー催行日の、
30日から8日前＝料金の5％
7日から3日前＝料金の10％
2日前＝料金の20％
前日＝料金の40％
当日＝料金の100％
10.5 但し、列車のチケット、その他のツアーでの旅行チケット、その他のチケット（劇場のチケットなど）、ミールクーポンやツアーに含まれていないその他のサービスや宿泊に関しては、予約の変更またはキャンセルをすることによって追加チャージがなされる場合がある。この追加チャージは移動費またはその他の費用の最高100％までが対象となり、予約時の支払額は返済されない。詳細に関してはウェブサイトを参照。
10.6 返済は予約支払いがなされたのと同じ方法にて行われる。
11 料金
11.1 総額に含まれているサービスはとは: ツアーに関係し、そして総額に含まれている旨が旅行日程に明記されている、バス代、ガイド料、（該当する）入場料、（食事付きの場合の）食事代、チップ等である。11.2 総額に含まれていないものは：旅行日程に記されていない飲物、食事、入場料、個人の諸経費、ツアー集合場所までの交通費である。
11.3 子供料金適用の際、身分証明書の提示を求める場合がある。
11.4 料金はユーロまたはポンドで請求されその他表示されている通貨（例えば日本円）は参考のためのみの表示である。料金はいつでも変更の対象となり得る。現地の税金の対象となる場合、税込みの料金が提示される。
11.5 税法の変更、通貨変動、サービス提供者によるツアー料金変更、またはみゅうによる過失や誤りがあった場合、予約確認済みでもみゅうは全ての料金において変更する権利を有する。
12 法的責任
12.1 該当する法律の枠内におけるみゅうの責任は以下のものに限定する:(a) 契約法、不法行為法（過失、法の不履行を含む）虚偽の陳述、、補償やその他本契約の履行に関連したみゅうの責任はいかなる場合でもブッキングをした時の総額を越えることはない。
(b) 特別な、また間接的な損害に関してはみゅうは責任を負わない。
12.2 サービス提供者によって商品が提供される場合は、個々のサービス提供者の責任はサービス提供者の規約に記されている。
13 サービス、料金の変更
13.1 現地事情によりツアーに含まれているサービスや料金が影響されることがある。可能な限りみゅうはツアー出発前にこの変更について利用者に連絡をする。14 荷物
14.1 荷物およびその他持ち物の損害・損失・盗難に関して、当社は責任を負わない。15 入場料
15.1 ツアーによっては観光名所に入場料を支払う必要がある。これが総額に含まれているかに関してはウェブサイトを参照。16 契約解除
16.1 本規約内の条項の一部または全てが違法または法的強制力がない場合、それ以外の本規約の条項、およびその条項内のその他の部分は効力を維持する。17 税金
17.1 その他の表示のない限り総額にはVATまたはツアーの目的地でのこれに相当する税金が含まれている。18 保険
18.1 旅行をする利用者、まは同行者にツアー出発前に旅行保険に加入することをみゅうは強く勧める。19 データ保護
19.1 予約をするにあたって提供された個人情報に対して、みゅうが利用者を代行し予約をし本規約内のみゅうの義務を達成するため、みゅうによるこの個人情報の保管および利用、そしてミキグループ会社、関係サービス提供者に開示することを利用者は承認する。みゅうによる個人情報取扱いの詳細に関してはみゅうのプライバシーポリシーを参照。20 他のウェブサイトへのリンク
第三者へのリンクは利用者の便宜のためのみに提供されている。リンクを利用することによって本ウェブサイトの管理下にないサイトに移ることになる。みゅうはリンク先ウェブサイトの評価、またその内容やアクセス可否に関する確認を行なっておらず、それらに関する責任を負わない。そのためみゅうは、これらリンク先ウェブサイトやその内容、そのサイトから得られる情報に関して一切の保証や表示を行なわない。本ウェブサイトから第三者へのウェブサイトのリンクの利用は個人の責任によるものとする。準拠法
20.1 本規約はツアーが開始する目的地の法律に準拠し日本旅行業法の対象にはならない。ツアーはその国のツアーオーガナイザーの旅行規約のもとに運営されているものである。現地の法律に違反した場合、または社会秩序、現地の習慣に反した行為をした場合、ツアーの参加を拒否する場合がある。この場合みゅうによる返済は行なわれない。
21 管轄
21.1 本規約により発生した、または本契約に関連した争議はツアーの目的地の裁判管轄下のみとする。22 言語
22.1 本規約は英語で作成されたものである。本規約が他言語に翻訳され、英語のものと翻訳されたもので相違がある場合、英語においての規約を優先とする。1 Introduction and Website Use
1.1 These terms and conditions (together with any terms and conditions of the Service Provider of the Tour where applicable) make up the agreement between you and Myu in relation to your use of this website and any Booking made by you (or on your behalf) on this website. Myu have the right to revise and amend this agreement from time to time. Please read the terms and conditions carefully before making any Booking on this website. Service Provider terms and conditions are available on request from the Service Provider. You should understand that by using this website or making a Booking, you agree to be bound by this agreement.1.2 To the maximum extent permitted by law, Myu disclaims all warranties, whether express or implied by statute, custom or usage relating to the information contained in this website and Myu shall not be liable for any losses or damages whatsoever, whether in contract, tort (including negligence), or otherwise arising from this website, or from any interruption or delay in accessing this website.
1.3 You should save or print a copy of these terms and conditions for future reference.
1.4 Please click on the button marked "I Accept" at the end of these terms and conditions if you accept them. Please understand that if you refuse to confirm that you accept these terms and conditions, you will not be able to make any Bookings through our site.
2 Definitions
Booking means any reservation for a Tour made by you on this website or by email and confirmed by Myu as booked;Service Provider means the service provider(s) referred to in clause 4 below and any other service providers appointed by Myu from time to time;
Total Price means the total charges payable to Myu for the Tour that is the subject of your Booking;
Tour means a tour organised by Myu or a Service Provider; and
Myu means the Miki group company organising the Tour as indicated on the Booking confirmation. The contact details of the relevant companies are set out at clause 3 below.

4 Service Providers
4.1 Certain Tours or services may be organised by third parties as indicated on the website.5 Your status
5.1 By placing an order through our site, you warrant that:(a) You are legally capable of entering into binding contracts; and
(b) You are at least 18 years old.
6 How the contract is formed between you and Myu
6.1 When you complete and submit an application for a Booking, Myu will send you an email confirming receipt. Please note that this does not mean that your reservation has been accepted.(Except for certain tours indicate in web form)
6.2 All applications are subject to acceptance by Myu, and, if your application for a Booking is successful, Myu will process payment for the Total Price.
6.3 Upon receipt of such payment, Myu will confirm by email our acceptance of your offer and it is only at this stage that a legal contract for the provision of that Tour will be created between you and Myu.
6.4 On receipt of payment for your Booking, a voucher will be issued to you for presentation for the services booked. You will also be advised if and where you need to collect any additional documents or tickets.
7 Payment
7.1 Payment of the Total Price may be made by Visa or Mastercard.8 Deadline for Applications for a Booking or receipt of a Cancellation
8.1 All applications for a Booking or Cancellation should reach Myu by 17:00 (local time for relevant Myu company), at least two working days prior to the day of the Tour departure (excluding weekends and public holidays).9 Myu's right to cancel
9.1 Myu can cancel your Booking and any Tours or other arrangements that Myu operate, for example for Tours that have a stipulated minimum group size (based on the number of adults travelling), if this minimum is not met, Myu will cancel the Tour. If this occurs, Myu will tell you as soon as reasonably possible and Myu will refund to you the Total Price paid for the Tour. Myu will have no liability to you for such cancellation. Applications for a Booking on a different Tour will be accepted if there are vacancies on other Tours. Please check with Myu to find out if such vacancies exist or if there are any future departure dates suitable to you.9.2 In cases of natural disasters, unforeseen disasters, coup d'etats, wars, strikes or acts of God, it may not be possible to proceed with the Tour. In such cases the Tour may be cancelled and Myu will not refund to you the Total Price paid for your Booking. Myu will have no liability to you for such cancellation.
9.3 Myu cannot guarantee events taking place, Tour destinations being open or resources and facilities being in operation for the Tour. There may be instances where the Tour will be cancelled by Myu due to local circumstances for example, unforeseen closures of sightseeing spots such as art museums, castles, traffic restrictions due to major events, and closures of restaurants.
10 Amendments and Cancellations
10.1 To cancel or amend a Booking, you must inform Myu by e-mail to the contact email address shown above as relevant to your Booking. For all Tours Myu will refund to you the Total Price paid for the Tour if your cancellation or amendment is received by Myu, at least two (2) working days prior to departure (excluding weekends and public holidays).10.2 For non London departure tours if you cancel or amend your Booking One (1) day prior to the Tour departure date (excluding weekends and public holidays) you will incur a 50% cancellation charge. Myu will refund to you half of the Total Price paid by you for the Tour.
For London departure tours if you cancel or amend your Booking Two (2) days prior to the Tour departure date (excluding weekends and public holidays) you will incur a 50% cancellation charge. Myu will refund to you half of the Total Price paid by you for the Tour.
10.3 For non London departure tours if you cancel or amend your Booking on the day or less than one (1) working day (excluding weekends and public holidays)you will incur a 100% charge and Myu will not refund any part of the Total Price to you.
For London departure tours if you cancel or amend your Booking on the day or less than two (2) working day(excluding weekends and public holidays) you will incur a 100% charge and Myu will not refund any part of the Total Price to you.
From July 25, 2012, until August 14, 2012. During this period cancellation fee - Cotswolds A, B, C course is 100% occurs at the same time as the application.
10.4 Cityrama tours Paris Cityrama tour's cancellation fee is as follow.
30-8 days before departure date = 5%.
7-3 days before departure date = 10%.
2 days before departure date = 20%.
1 day before departure date = 40%.
Departure day = 100%.
10.5 However, for train tickets, other Tours that require travel tickets, other tickets (such as theatre tickets), meal coupons or other services and accommodation not included in the Tour, amendments or cancellation of the Booking may incur additional costs which may be up to 100% of transport or other applicable costs and the full payment made at the time of the Booking will not be refunded. For further details please refer to the website.
10.6 Myu will usually refund any money received from you using the same method originally used by you to pay for your Booking.
11 Prices
11.1 Services covered in the Total Price are: Bus charges, guides costs, entrance fees (where applicable), meal charges (where meals are provided) and tips etc. that relate to the Tour and are clearly stated in the Tour itinerary as being included in the Total Price.11.2 Services not covered in the Total Price are: Drinks and meals that are not listed in the Tour itinerary; entrance fees not listed in the Tour itinerary; any personal incidental costs; any personal travel costs to the Tour assembly point.
11.3 Where child fees are applied, Myu may ask you for proof of age.
11.4 Prices are charged in Euros or Sterling and conversions shown in any other currency (for example JPY) are given for guidance only. Prices are subject to change at any time. Local taxes may apply and will be included in the price.
11.5 Myu reserve the right to amend all our prices, even after Myu have confirmed your Booking, if there are a changes in governmental taxes, currency fluctuations and Tour rate changes imposed by a Service Provider or where there has been an error or mistake made by Myu.
12 Liability
12.1 In so far as is permitted under applicable law, Myu's liability to you shall be limited as follows:(a)Myu's total liability to you in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of this agreement will in no circumstances exceed the Total Price paid for the Booking at the date of the claim in respect of any event or a series of events.
(b)Myu shall not be liable to you for any special, indirect or consequential loss.
12.2 Where any product is provided to you by a Service Provider, the Service Provider's individual liability will be set out in the Service Provider's terms and conditions.
